Here is a “first news report” on a hearing  that took place in Congress today on National Legislation coming in response to the Burr Oak Cemetery Scandal.  Congressman Bobby Rush had a hearing today January 27th 2009, on the Bereaved Consumers Bill of Rights Act. The bill is H.R.3655.

“WASHINGTON–In the wake of hundreds of grave desecrations at the historic Burr Oak Cemetery in south suburban Alsip, House Democrat Bobby Rush of Chicago wants to bolster federal consumer protections governing the sale of funeral goods and services.

Rush today led a congressional hearing to examine whether the FTC, which regulates funeral homes, should have its purview expanded to include cemeteries, crematories and sellers of caskets, urns, monuments and markers.

Most cemeteries operate as non-profits, a realm the FTC generally does not investigate, said Charles Harwood, deputy director of its Bureau of Consumer Protection. Under Rush’s proposal, the FTC would take oversight of such cemeteries.
The Burr Oak Cemetery made national news in July when it was learned that hundreds of corpses had been unearthed over several years anddumped into a weeded area of the cemetery or double-stacked in other graves.

The cemetery is the resting place of Emmett Till, whose murder helpedfuel the civil rights movement, and blues singer Dinah Washington,among other notables.

A Service Corporation International Cemetery, 500 graves desecrated, was a contributing factor in the Legislation

Rush said the horrific activities at Burr Oak were not an aberration,citing new allegations of desecrating graves and reselling plots later surfaced in Mission Hills, Calif., and DeKalb County, Ga.

“Just because death all too often comes like a thief in the night,” he said, “bereaved consumers should not be left wondering who, in fact,was the real thief: death or the cemetery salesperson.”

Patricia Brown Holmes, a retired judge who led an Illinois task forcethat led to tougher, just-enacted laws governing cemeteries in thestate, spoke in favor of Rush’s measure.

Holmes said the average consumer thinks of a funeral home and cemetery as one in the same, even though under federal laws, funeral homes areheavily regulated and cemeteries are not.

The National Funeral Directors Association also supports the measure,said Randall Earl, who has a funeral home and crematory in Decatur,Ill.

He told the panel that existing FTC rules pertaining to funeral homes do not cover casket sellers such as Wal-Mart and amazon.com, so the association wants the rules updated to cover them.

Under Rush’s proposal, new FTC regulations would require cemeteries andthe other newly covered sectors of the death-care industry to provide pre-sale price disclosures.

Misrepresentations would be prohibited and clear contracts itemizing goods, services and prices would be required.

A representative of the International Cemetery, Cremation and FuneralAssociation said cemeteries and funeral homes were best regulated at the state level.  Paul M. Elvig said most cemeteries operated as nonprofits, including those run by religious, municipal and fraternal organizations, and the new regulations would disproportionately affect them “in ways that would never pass a cost/benefit analysis.”

Rush’s bill, called the Bereaved Consumer’s Bill of Rights Act, has five co-sponsors.

The main danger is very simple. THE FUNERAL DIRECTOR RUNS OFF WITH YOUR MONEY. Those who do this are usually the leaders of a Funeral Directors Association,IFDA(59 Million dollars) or a large insurance enterprise,  NPS (National Prearranged Services-1 Billion dollars.)  Buying a  funeral or cemetery Preneed Policy has another real danger for the consumer: LAWSUIT POSSIBILITY.

The six dangers of prepaying a funeral:

    • With some trust fund and insurance funding options there may be no refund if someone wants to cancel the plan in the future.
    • # If a purchaser moves to another state there may be no transfer options or there may be different rules governing the funding option.
    • # In some contracts, interest earnings on investments resulting in excess money not needed for the plan may be retained by the funeral home or funeral director.
    • # On installment plans interest may be charged but not credited to the account.
    • # In certain insurance funded contracts, the ownership or death benefit may be irrevocably assigned to the contract holder (funeral home), preventing the purchaser from enjoying ownership rights in the policy.
    • # In certain insurance funded contracts, a growth in the death benefit over time that exceeds the cost of the preneed plan services and goods may be pocketed by the contract holder (funeral home) instead of being refunded.-Snippet From Brazos Lawyer.

The consensus seems to be that there should be one agency regulating Funerals and Cemeteries in Illinois. This is a good thing. The not so good thing is that it may be a while before the regulation is put into place. The Governor in the State  wants  the Illinois House Task Force on the Illinois Funeral Directors Association(IFDA)Ponzi Scheme to  have hearings and report first.

From the State Journal Register in Springfield, IL:

“IT SEEMS to be almost unanimous: The Illinois comptroller should not be in charge of regulating the state’s cemeteries. Instead, regulatory authority should be placed solely in the hands of the state Department of Financial and Professional Regulation.”

But Illinois  Governor Patrick Quinn does not want Funeral or Cemetery reform until after January 2010.

The Cemetery Oversight Task Force in Illinois has issued it’s report to the Governor of the State of Illinois Patrick Quinn. To sum up the report, Cemetery Scandal is widespread across the State of Illinois and Legislative and regulatory action should be immediately taken.

“A state task force set up to investigate the burial industry in the wake of widespread grave desecration at a cemetery outside Chicago concluded that abuse was probably widespread across the state due to a near-complete lack of regulation, the group told Gov. Patrick J. Quinn in a report.”

This all was brought on by the Burr Oak Cemetery Scandal near Chicago where nearly three hundred graves were desecrated and bones piled up around the cemetery.

The ICCFA is supporting Cemetery Reform Because of the horrific Burr Oak Cemetery Scandal

The International Cemetery Crematory Funeral Association (ICCFA) is open to reform of the Death Care Industry. Death care is what happens from the  funeral home to the cemetery. The Burr Oak  Cemetery Scandal in  the Chicago Area has stirred up calls for cemetery reform.

At Burr Oak  in cemetery near Alsip Illinois 300 graves were desecrated. 2 sections of the Cemetery are a crime scene. Bones were discarded and piled up. The scope and nature of the Burr Oak Crime is an unspeakable horror.

Reform is not the total answer. More laws are needed. Regulation is needed.Enforcement  This is true both on the Funeral side and the cemetery side of the business of death. Laws enforced do not always prevent crime.

Bob Fells, the general counsel for the Virginia-based International Cemetery, Crematory, and Funeral Association said his organization is open to beefing up regulation to prevent atrocities like the one at Burr Oak. “This is so essential to cemetery operation, the integrity of the gravesite,” said Fells, who cautioned that stronger legislation still won’t be able to stop criminal activity. “If somebody wants to walk into a bank and rob it, you probably aren’t going to be able to stop them. It’s a similar thing with illegal disinterment,” said Wells.

EDUCATION NEEDED

If folks are educated about what is involved in the Funeral  and Cemetery Process in death care there will be less crime. They will not be ripped off when there is good laws enforcement and EDUCATION about the Funeral and Cemetery Process.
