The Bereaved consumers Bill Of Rights Act is coming up for a vote in a Congressional Committee on Wed 7.21.10. This is an Important Congressional Vote for historic cemetery and death care reform.

The Bereaved Consumers Protection Act is in the the legislative process in the US Congress.

Recent Cemetery Scandals could have been prevented if this bill had been in effect. Those are the Burr Oak Cemetery Scandal, The Eden Memorial Park Scandal and the recent Scandal at Arlington National Cemetery.

World's Largest Funeral Corporation has had a cemetery Scandal, like Bur Oak

Cemeteries often have little regulation  and get away with price gouging. Recently I helped a Friend with a a grave site purchase and because there was no Law I could do nothing about the $4700.00 Price Gouging. This was a corporate ,NYE:SCI, Service Corporation International cemetery,  price gouging.

I have issued a Call to Action on the Wed, 7.21.10. possible committee vote.

“ACTION NEEDED: House Committee Expected to Act on Bereaved Consumer’s Bill of Rights
The House Energy and Commerce Committee is expected to meet in the coming week to consider and vote on the “Bereaved Consumer’s Bill of Rights Act of 2009″ (H.R. 3655), a bill which would direct the Federal Trade Commission (FTC) to initiate a separate rule covering all sellers of funeral or burial goods or services, including cemeteries, crematories and third-party sellers of funeral or burial goods or services.

The bill was pulled from committee consideration in early May at the request of its primary sponsor, Rep. Bobby Rush, D-Ill., because of his opposition to a proposed amendment that would exempt non-profit religious cemeteries from the bill. Rush was concerned that for-profit cemetery operators could use the exemption to escape the requirements of the rule. While there was bipartisan support for the bill, and it most likely would have passed had the amendment not been introduced, it was pulled so committee staff could draft language that would address concerns about non-profit and religious cemeteries.

Because the Energy and Commerce Committee is expected to discuss this bill very soon, it is vital that you contact your representatives to demonstrate your support for this important legislation.

What is H.R. 3655?
H.R. 3655 would require the FTC to initiate a separate rule covering all sellers of funeral or burial goods or services, including cemeteries, crematories and third-party sellers of funeral or burial goods or services.

Why support H.R. 3655?
Through the Funeral Rule, the federal government regulates a portion, but not all segments, of funeral service. Consequently, consumers are only protected when they deal with funeral homes. H.R. 3655 would set a minimum national standard with which all sellers of funeral or burial goods or services – including non-profit and religious organizations – not covered by the Funeral Rule must comply. It would only apply to those who sell funeral or burial goods or services to the public, not to other businesses.

A lack of minimum national standards and inadequate state regulation has resulted in numerous serious scandals involving cemeteries and crematories. These scandals have caused untold emotional and financial stress and strain for consumers. These scandals have also damaged the reputation of the funeral service profession. A uniform federal rule is the only solution.

If passed, this bill would protect families by requiring cemeteries, crematories and third-party providers to provide minimum disclosures and establish practice requirements and prohibitions comparable to those that funeral homes must comply with under the Funeral Rule.

H.R. 3655 would not impose new fines or penalties. The fines and penalties that would apply to cemeteries, crematories and other third-party sellers under H.R. 3655 are the same ones that apply to funeral homes”

The Bereaved Consumers Bill Of Rights Act is Moving Through Congress

One would hope that congressman Joe Barton would keep his Mouth shut at this next hearing as he has seemed to put his foot in his mouth last time the committee met on this, and when he spoke out on the BP Oil spill!

THE ICCFA is against this legislation, the Funeral Consumers Alliance is for it, along with the NFDA.

Cemetery maintenance often comes to a standstill in a down economy

In a sign of the times a Funeral Director has gone before his City Council and pleaded for his city Cemetery. This all went down in Central Ohio. this is some interesting funeral news.

The City Cemetery appears to be  be the causality of the recession and budget cuts.

“A local funeral director says the city of Marysville should reconsider a recommendation to scale back operations at Oakdale Cemetery.

Daryl Ingram of Ingram Funeral Home addressed city council members Thursday night, asking them to reconsider a proposal from the city administration to eliminate two full-time employees and one part-time employee who currently make up the city’s cemetery department.”-via www.thisweeknews.com

This city is considering running the cemetery with non  professionals. When having a burial at a city, or private cemetery it is important to make inquiries about ownership and maintenance. This will help you come in under the average cost of a funeral.

It is also a lesson from the Burr Oak Cemetery Scandal: Check up on the maintenance an the owners of the cemetery of your choosing.

much to do about nothing. Yes there is the usual SCI Mismanagement. But it really has nothing to do with anything but the license on the wall.

In a Chicago Sun Times article entitled

“Making sure her brother rests in peace
After Burr Oak scandal, this sister is taking no chance”

the newspaper did a story  on the Scandal Ridden “World’s largest funeral corporation” But other than a license not being updated on the wall. There is no story. Only a gravestone moved for a backhoe and then put back in place.

A customer found a license that was not updated, but it is not clear if it was a license to sell headstone or a full cemetery business license.

This all went down at Oak Woods Cemetery.

As is the case with Burr Oak, the company that runs Oak Woods Cemetery is from out of state.

The Houston-based Service Corporation International boasts of operating funeral homes and cemeteries all over North America.

Gonnigan isn’t impressed.

She noticed that the City of Chicago business license that was on display in the cemetery’s office on Monday had expired.

When I asked about the license, Jennifer Brandino, a spokeswoman for Service Corporation International, e-mailed this response:

“It was our understanding that our license is current, but we are currently investigating its status and are taking any appropriate measures to reinstate it if necessary.”

A spokeswoman for the city noted that Chicago does not license cemeteries, but does require a license for the sale of headstones

This is a glaring example of how the press lacks judgment in identifying  true funeral|cemetery scandal

The Cemetery Oversight Task Force in Illinois has issued it’s report to the Governor of the State of Illinois Patrick Quinn. To sum up the report, Cemetery Scandal is widespread across the State of Illinois and Legislative and regulatory action should be immediately taken.

“A state task force set up to investigate the burial industry in the wake of widespread grave desecration at a cemetery outside Chicago concluded that abuse was probably widespread across the state due to a near-complete lack of regulation, the group told Gov. Patrick J. Quinn in a report.”

This all was brought on by the Burr Oak Cemetery Scandal near Chicago where nearly three hundred graves were desecrated and bones piled up around the cemetery.

The ICCFA is supporting Cemetery Reform Because of the horrific Burr Oak Cemetery Scandal

The International Cemetery Crematory Funeral Association (ICCFA) is open to reform of the Death Care Industry. Death care is what happens from the  funeral home to the cemetery. The Burr Oak  Cemetery Scandal in  the Chicago Area has stirred up calls for cemetery reform.

At Burr Oak  in cemetery near Alsip Illinois 300 graves were desecrated. 2 sections of the Cemetery are a crime scene. Bones were discarded and piled up. The scope and nature of the Burr Oak Crime is an unspeakable horror.

Reform is not the total answer. More laws are needed. Regulation is needed.Enforcement  This is true both on the Funeral side and the cemetery side of the business of death. Laws enforced do not always prevent crime.

Bob Fells, the general counsel for the Virginia-based International Cemetery, Crematory, and Funeral Association said his organization is open to beefing up regulation to prevent atrocities like the one at Burr Oak. “This is so essential to cemetery operation, the integrity of the gravesite,” said Fells, who cautioned that stronger legislation still won’t be able to stop criminal activity. “If somebody wants to walk into a bank and rob it, you probably aren’t going to be able to stop them. It’s a similar thing with illegal disinterment,” said Wells.

EDUCATION NEEDED

If folks are educated about what is involved in the Funeral  and Cemetery Process in death care there will be less crime. They will not be ripped off when there is good laws enforcement and EDUCATION about the Funeral and Cemetery Process.
